Introduction
We at the “Ralty V” application (hereinafter referred to as the “Application”) are committed to protecting the privacy of all our application users (“User”). We recognize the importance of your personal data and pledge to handle it with full responsibility and in complete compliance with the provisions of the Personal Data Protection Law issued by Royal Decree No. (M/19) dated 9/2/1443 AH and its Implementing Regulations, as well as all relevant laws applicable in the Kingdom of Saudi Arabia. This policy explains how we collect, use, share, and protect your personal data. Your use of or registration in the Application constitutes your express consent to all the terms of this policy.
First: Definitions
For the purposes of this policy, the following terms shall have the meanings set forth below:
- The Application: Refers to this electronic application, in all its versions and editions available on various operating systems and devices (such as smartphones and tablets), through which services and products are rated.
- Ralty App: Ralty is a digital platform that allows users to post their ratings and opinions about products and services.
- Application Owner: The founding entity that owns and manages the Application, responsible for its operation and making it available for users to browse services and providing the technical platform.
- User: Any natural or legal person who uses the Application and creates an account or uses it to browse content and ratings.
- Personal Data: Any data—regardless of its source or form—that would lead to the identification of an individual specifically, or make them identifiable directly or indirectly.
- Processing: Any operation performed on personal data, such as collecting, recording, storing, using, sharing, or destroying it.
- Registration: The process by which the user creates a new account, usually requiring personal information such as name, mobile number, email, and creating a password.
- Financial Consideration: The monetary amounts paid by the user for their subscription to the Application.
- Saudi Riyal: The official currency approved in the Kingdom of Saudi Arabia; all amounts, prices, fees, and commissions mentioned in this agreement are valued in it unless expressly stated otherwise.
- Personal Profile: The user’s personal account within the Application, containing personal information entered during or after registration, in addition to their activity log.
- Systems: All technical systems, software, infrastructure, servers, networks, and databases that the Application relies on to function correctly and effectively.
- IP Address: When browsing or subscribing, the server records the IP address of visitors or users, including the date and time of the visit, browser type, and the URL of any site that may have referred the user to the Application, for the purpose of collecting general information to provide better services.
- Cookies: Small files used to track user or visitor actions within the platform to provide the best possible user experience and ensure they do not see repetitive offers and advertisements.
- Confidential Information: Includes any data or information not available to the public, whether technical, commercial, or personal, disclosed by one party (“Disclosing Party”) to the other party (“Receiving Party”).
- Receiving Party: The party receiving the disclosed confidential information.
- Disclosing Party: The party that owns the confidential information or has the legal right to disclose it to the (“Receiving Party”).
- Content Creator (Creator): The user who uploads visual reviews (video or photos) of products via the Application.
- User-Generated Content (UGC): Any visual or textual material (videos, images, comments) uploaded or shared by the user via the platform.
- Rating System: The tool provided by the platform for users to rate products based on specific criteria from 1 to 5 stars.
- Artificial Intelligence (AI Tools): Refers to software technologies and algorithms provided by the Application to process data and generate suggested texts, such as captions and tags, to assist content creators. These tools are considered guiding means subject to the user’s full review and responsibility before publishing.
Second: Terms of Use and General Provisions
Legal Eligibility and Membership Conditions:
- The natural user or the legal representative of a company acknowledges that they are at least eighteen (18) years old and possess full legal capacity to conclude contracts and execute resulting obligations.
- Any use of the Application by a minor is considered a breach of this agreement and is under the full responsibility of their guardian.
Account Responsibility:
- The user is fully responsible for maintaining the confidentiality of their login information (username, password, and email) and for all activities and transactions occurring through their account.
- The user must immediately notify the Application management via official communication channels of any unauthorized use of their account or any other security breach.
Agreement Approval and Amendments:
- Your use of or registration in the Application is an irrevocable acknowledgment that you have read, understood, and agreed to abide by all its provisions. This approval constitutes an electronic signature effective under the Saudi Electronic Transactions Law.
- If you do not agree to any part of this agreement, you must immediately cease using the Application and delete your account.
- The “Application Owner” reserves the right to modify or update this agreement at any time. Users will be notified of material changes via the Application or registered email, and continued use after the modification date constitutes express consent to the amended version.
Legitimate Use of the Application:
- The user commits to using the Application only for its intended purposes and in a lawful manner compliant with applicable laws in Saudi Arabia. This includes, but is not limited to:
- Communicating respectfully and professionally with the support team.
- Providing correct and accurate information.
- Providing honest and fair product ratings based on personal experience.
- Adhering to public morals and Islamic ethics in all interactions.
- The user pledges full compliance with all laws in Saudi Arabia, including the Anti-Cybercrime Law and the E-Commerce Law.
Prohibited Activities: The user is strictly prohibited from engaging in any of the following activities; committing any of them constitutes a material breach, granting the “Application Owner” the right to terminate the account immediately and seek legal compensation:
- Using the Application to harm, harass, or deceive others.
- Attempting unauthorized access to servers, databases, or other users’ data.
- Publishing viruses or malicious software intended to harm the Application or its users.
- Impersonating any person or entity or using another user’s account without authorization.
- Providing forged or misleading information in the personal profile.
- Posting any immoral, indecent, or contrary to public values content, especially in the Saudi and Middle Eastern markets.
- Using offensive, defamatory language, or hate speech toward individuals, groups, or brands.
- Posting fake or “paid” ratings without explicit disclosure, or attempting to manipulate the rating system.
- Impersonating another user, brand, or content creator.
- Uploading videos or photos owned by others without permission; content must be the user’s original work.
- Using the Application to promote counterfeit products or infringe on intellectual property rights.
- Placing external links to suspicious sites or advertising links outside the system.
Ownership and User-Generated Content (UGC) License:
- The user retains all intellectual property and copyrights for the content (videos, images, texts) they upload to RatlyV.
- However, by uploading content, you grant the platform the licenses described in this agreement.
Use of Artificial Intelligence (AI Tools):
- RatlyV provides AI tools to help generate suggested captions and tags. These are “aids” and not a substitute for human review.
- The user bears full responsibility for any text or tag generated by AI tools within the Application.
- The user must review the resulting content for accuracy and appropriateness before publishing.
- The Application does not guarantee that AI-generated texts will be accurate, true, or free from linguistic or technical errors.
- It is prohibited to use AI tools to generate misleading, hostile content or to manipulate the rating system.
Payment Policy and (PRO) Subscription:
- RatlyV offers (weekly or annual) subscriptions referred to as (PRO).
- The user is committed to paying the fees specified in the Application, including VAT where applicable.
- Payment is made via available methods (e.g., Apple Pay, Google Pay, or credit cards).
- Auto-Renewal: Users agree that all (PRO) subscriptions are subject to auto-renewal.
- Refund Policy: Once the payment is completed, the amount is strictly non-refundable, whether in full or in part. No refunds are provided for unused days if the user stops using (PRO) features before the period ends.
- Cancellation: The user has the right to cancel the “Auto-Renewal” feature at any time.
Third: Disclaimer and Limitation of Liability (Platform Role)
- Service “As Is”: Application services are provided “as is” and “as available” without any warranties, express or implied. The owner does not guarantee uninterrupted or error-free service.
- User Conduct: The Application disclaims all liability for any actions, negligence, or misconduct by any user.
- Rating Accuracy: The Application is not responsible for the accuracy, truth, or credibility of user ratings. The user (content creator) bears full legal responsibility for their content.
- Product Quality: The Application is not responsible for the quality, safety, or conformity of products appearing in reviews. Full legal liability for product defects lies with the manufacturer, brand, or seller.
- Disputes: The Application is not a party to any dispute between users, or between a user and a seller/brand.
- Damages: The Application, its owners, or employees are not liable for any losses or damages (direct or indirect) resulting from using the Application or relying on its content.
Fourth: Collection of Personal Data
- The Application collects personal data only as necessary to provide its services, including but not limited to:
- Identification Data: Name, mobile number, email, encrypted password, and login information.
- Personal Profile: Photo, bio, and preferences.
- Technical and Usage Data: IP address, device identifiers, OS type, crash logs, and in-app interactions.
- Rating Data and Correspondence: Ratings provided, complaints, reviews, and comments within the internal messaging system.
Fifth: Legal Basis for Data Processing
Personal data is used for the following purposes:
- Facilitating requested services.
- Verifying user identity.
- Processing payments and electronic requests.
- Communicating for technical support or security alerts.
- Improving service quality and user experience.
- Compliance with Saudi Arabian laws and regulations.
- Protecting the platform’s rights against fraud.
- Using AI to analyze usage patterns and content to provide smart suggestions (tags/descriptions) and improve content accuracy.
Sixth: Data Protection
We take all necessary organizational, technical, and administrative measures to protect your data from loss, theft, misuse, or unauthorized access. Measures include:
- Encrypting sensitive data during transmission and storage.
- Strict access control policies based on the “need to know” principle.
- Continuous updates to protection procedures according to approved Saudi Arabian standards.
Seventh: Data Sharing
The Application does not share personal data with external parties except:
- In case of a legal obligation before judicial or security authorities.
- With external service providers (e.g., payment gateways) under binding confidentiality contracts.
- In case of merger or sale of the platform, with user notification.
Eighth: User Rights
Under the Personal Data Protection Law, users have the right to:
- Knowledge: Of the legal basis and purpose of data collection.
- Access: Request a copy of their processed personal data.
- Correction: Request correction or updating of inaccurate data.
- Destruction: Request data deletion when the purpose expires, unless a legal basis requires retention.
- Withdraw Consent: At any time (not affecting the legality of processing prior to withdrawal). Requests can be submitted via the official contact methods below.
Ninth: Data Retention Period
Personal data is retained as long as necessary to achieve the collection purposes or fulfill legal obligations, then deleted or anonymized.
Tenth: Cookies
The Application may use cookies to improve experience and analyze performance. Users can manage these via browser settings.
Eleventh: Amendments
We reserve the right to update this policy. Users will be notified of material changes via email or a prominent notice within the Application. Continued use constitutes acceptance of the updated version.
Twelfth: Data Transfer Outside the Kingdom
Providing services may require technical providers (e.g., cloud computing) outside Saudi Arabia. We pledge not to transfer data unless a sufficient level of protection is ensured in compliance with the Personal Data Protection Law.
Thirteenth: Governing Law and Jurisdiction
This policy is governed by the laws of the Kingdom of Saudi Arabia. Competent courts within the Kingdom shall have jurisdiction over any disputes.
